Cake Club Membership Service Agreement

This Cake Club Membership Service Agreement ("Agreement") is entered into by and between Customer ("Customer") and Alla's Yummy Food ("Company") as of this date by ticking the box. 

Membership Services: 1.1 The Customer is purchasing a yearly membership in the Cake Club, which grants access to exclusive benefits and discounts on cakes and related products offered by the Company. 

1.2 The membership is valid for a period of one (1) year from the date of purchase and will automatically renew annually unless canceled by the Customer in accordance with the cancellation policy outlined in Section 5.

Membership Fees: 2.1 The Customer agrees to pay the annual membership fee as specified by the Company at the time of purchase. 2.2 The membership fee is non-refundable and non-transferable, except as otherwise specified in this Agreement.

Membership Benefits: 3.1 The Customer will be entitled to the following benefits during the membership period: 

Exclusive discounts on cakes and related products offered by the Company. - Priority access to new and exclusive cake flavors, limited-edition items, and special promotions. 

Access to a closed Facebook group for interaction with fellow members and sharing cake-related discussions. 

Support and assistance for any questions related to mousse cakes, sponge cakes, and cheesecakes throughout the year. 

Live Mastermind coaching sessions with Alla to improve sales, mindset, and business growth. 

Access to a selection of cake recipes exclusively available to Cake Club members.

 Access to webinars organized by the Company. 

Community of like-minded bakers for networking and collaboration.

3.2 By joining the Cake Club, you gain access to exclusive cakes, mastermind sessions, group support, and more, enhancing your cake baking and business skills.

Intellectual Property: 4.1 All materials, including but not limited to recipes, videos, webinars, and written content, provided as part of the Cake Club membership, are the intellectual property of the Company. The Customer agrees not to reproduce, distribute, or use such materials for commercial purposes without the explicit written permission of the Company.

Cancellation and Termination: 5.1 The Customer may cancel their membership at any time by visiting their account on the Alla's Yummy Food website and clicking on the "Cancel Membership" button. Alternatively, the Customer may send an email to [email protected] requesting cancellation, and the Company will promptly process the cancellation. 

5.2 Upon cancellation, the Customer will no longer have access to the Cake Club benefits, and the automatic renewal for the next membership year will be canceled. 

5.3 The membership fee is non-refundable, and no partial refunds will be provided for the unused portion of the membership year. 

5.4 The Company reserves the right to terminate or suspend a membership in the event of a breach of this Agreement or any misuse or abuse of the membership benefits by the Customer.

Limitation of Liability: 6.1 The Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the Customer's membership in the Cake Club or use of the membership benefits. 

6.2 The Customer acknowledges and agrees that participation in any activities or events organized by the Company as part of the membership is voluntary, and the Customer assumes all risks associated with such participation.

Governing Law and Jurisdiction: 7.1 This Agreement shall be governed by and construed in accordance with the laws. 7.2 Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of your state. 

Entire Agreement: 8.1 This Agreement constitutes the entire agreement between the Customer and the Company regarding the Cake Club membership and supersedes all prior agreements, understandings, or representations, whether oral or written.

By purchasing the Cake Club membership, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions set forth in this Agreement.
