Payment Agreement for the Cake Business Builder Package
Payment Commitment Agreement ("Agreement") is entered into by and between the Client ("Client") and Alla's Yummy Food ("Company") as of this date by ticking the box.
Package Details:
1.1 The Client is enrolling in the Cake Business Builder Package ("Package"), which includes services to help set up and develop the Client's cake business, including landing page creation, store setup, and related business-building tools.
1.2 The Package includes up to 1 revision for the landing page and store setup. Additional revisions will incur an extra fee of $100 per revision.
1.3 The Client acknowledges that their participation in the Package also includes adherence to the policies outlined under "Policies and Client Responsibilities."
Payment Commitment:
2.1 By enrolling in the Package, the Client agrees to make a one-time payment of $3,500, unless an installment plan is agreed upon in writing with the Company.
2.2 All installment payments are due on the agreed dates. Work will pause if payments are late and will not resume until the balance is paid in full.
2.3 The Client acknowledges and agrees that all payments made under this Agreement are non-refundable, including any upfront payments, partial payments, or full payments.
Package Access and Deliverables:
3.1 The Client will receive access to the Package services and deliverables upon payment confirmation and completion of any required onboarding processes.
3.2 Ownership of deliverables (e.g., website, email sequences) will transfer to the Client only after full payment is received.
3.3 Any requests outside the agreed scope of work will be billed at $100/hour or $500 per additional task.
Client Responsibilities:
4.1 The Client agrees to provide all required materials (e.g., photos, descriptions) promptly to avoid delays in the project timeline.
4.2 The Client agrees to actively engage in the process and complete assigned tasks as requested.
4.3 The Client acknowledges that the success of the Package is dependent on their cooperation, participation, and timely completion of assigned tasks.
Revisions Policy:
5.1 The Client is entitled to 1 revision for the landing page and store setup.
5.2 Additional revisions will incur a fee of $100 per revision.
Call Policies:
6.1 All scheduled calls must start on time.
6.2 Late arrivals beyond 15 minutes will result in the forfeiture of the call, and no rescheduling will be offered.
6.3 Missed calls without prior notice ("No-Shows") will not be rescheduled.
Refund Policy:
7.1 No Refunds: The Client acknowledges and agrees that all payments made for the Cake Business Builder Package are final and non-refundable due to the custom nature of the services provided.
Termination Clause:
8.1 The Company reserves the right to terminate this Agreement and cease all services if:
- The Client is uncooperative or repeatedly delays required tasks.
- The Client violates any of the terms outlined in this Agreement.
8.2 In the event of termination, all payments made prior to termination will remain non-refundable.
Limitation of Liability:
9.1 The Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the Client's participation in the Cake Business Builder Package or use of the Package deliverables.
Governing Law and Jurisdiction:
10.1 This Agreement shall be governed by and construed in accordance with the laws applicable in the Company's location.
10.2 Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in the Company's location.
Entire Agreement:
11.1 This Agreement constitutes the entire agreement between the Client and the Company regarding the Payment Commitment for the Cake Business Builder Package and supersedes all prior agreements, understandings, or representations, whether oral or written.
11.2 The contents of the Package, including but not limited to templates, strategies, tools, and resources, are protected by copyright law. No part of the Package may be reproduced, distributed, or transmitted in any form or by any means, including photocopying, recording, or other electronic or mechanical methods, without the prior written permission of the Company.
Unauthorized use, reproduction, distribution, or transmission of the materials in this Package may result in severe civil and criminal penalties, and legal action may be taken against individuals or entities found to be in violation of the copyright laws.

11.3 By enrolling in this Package, the Client agrees to abide by the copyright and intellectual property laws and refrain from sharing, selling, or participating in any unauthorized distribution of the Package materials.
Acknowledgment:
By enrolling in the Cake Business Builder Package and agreeing to this Payment Agreement, the Client acknowledges that they have read, understood, and agreed to the terms and conditions set forth in this Agreement.
